Terms and Conditions
XINX Fitness is a group fitness gym located at Unit 5 The Warren, East Goscote, Leicestershire, LE7 3XA owned by XINX Limited.
These terms and conditions apply to your use of the XINX website (xinx.co.uk) and the purchase of Good and Services from us. When we are referring to XINX Limited “we” “us” and “our” will be used. XINX facilities will be referred to as the Gym in this document. When we refer to “you” and “your” we mean the user of this website, purchaser of goods and services or clients of our services.
All clients must comply by these gym rules at all times. Refusal or continual non-compliance with these Rules may result in the Gym user being ejected from the premises and termination of Membership if applicable.
XINX Fitness reserves the right to make changes to the Gym Rules from time to time, and any changes will be effective immediately.
All users must be 18 years or older or 16 with written consent of a parent/legal guardian.
All users are only permitted into XINX having completed the sign up/class booking process online.
The name under which the class is booked must be the person participates in the class.
All participants must fill out our health and safety questionnaire prior to participating in class. This can be found in your booking confirmation email and completed online or completed on paper prior to class participation.
Physical CONDITION OF CLIENT
The client confirms in participating in XINX fitness class that they are in good physical condition and know of no reason why an exercise program would be detrimental to their health and have not been advised by a physician to avoid physical activity. If there are any changes to the client’s condition the class instructor must be made aware and a new health and safety questionnaire must be completed by the client.
Cancellation, REFUND, and CREDIT EXPIRY POLICY
There are no refunds for classes cancelled within 24 hours of class or missed classes. For NIX members, we reserve the right to restrict attendance if a class is cancelled within 24 hours of the class or a class is missed. For classes purchased with a credit card, you are entitled to a full refund if you cancel your booking more than 24 hours prior to class. For classes purchased using credits, your credits will be refunded for classes cancelled more that 24 hours prior to class. There will be no refunds on class package deals; however, classes booked using these credits can be refunded for credits if cancellation is done prior to 24 hours before the class start time.
Credits expire 6 months after they are purchased.
LIMITATION OF LIABILITY
In using the gym and XINX facilitates the client agrees that:
Neither the gym, the company, or the employees of XINX shall be liable for any loss, damage or theft of personal property belonging to the client upon the studio premises.
Neither the gym, its employees or XINX Ltd. Shall be responsible for any death or injury occurring on the gym’s property or as a result of participation in XINX exercise classes, except in the condition that personal injury or death result from any negligent act or negligent omission on the part of XINX Ltd.
XINX lockers are for day use only. XINX reserves the right to open and remove items from the locker if left overnight. Any items left in lockers overnight will be placed in lost and found.
Any property found left unattended in the gym will be kept for a reasonable period, and then may be donated to charity.
For your safety, we cannot allow entrance to class once the warm up begins. If a class participant is late and not allowed to enter class this would be considered a “missed class” and would therefore not be eligible for a refund as per our cancellation, refund and credit expiration policy.
All gym users are expected to wear suitable attire at all times while using the Gym facilities.
All gym users should use suitable measures to maintain basic standards of hygiene, such as using deodorant, showering if needed, and wearing clean gym attire whilst training.
All clients must conduct themselves in a respectful manner whilst using gym facilities. Any gym user who acts in an intimidating, abusive, violent or disrespectful manner may be ejected from the gym, and Members may have their Membership terminated with no refund of fees already paid.
Any clients who are unsure of how to use a piece of equipment should seek instruction before doing so.
XINX will not take any responsibility where a gym user sustains injury from incorrect use of equipment. If any equipment is found to be faulty or malfunctioning, please report this to XINX staff immediately.
All clients must comply with any reasonable request from XINX staff in relation to health and safety, and to ensure smooth running of the gym.
XINX timetables, coaches and classes are subject to change at any time. XINX will endeavour to provide notice when a class is unable to take place for any reason.
Clients are recommended to book in advance to ensure that a class has space for them. Clients can book classes online up to 1 week in advance. While NIX premium members are granted unlimited class credits they are not guaranteed access to any particular class and must undergo the online sign up process as all clients must.
GENERAL HEALTH AND SAFETY
If any gym user has concerns in relation to health and safety, they must report the issue to XINX Training staff immediately.
